Yes, Toby's dead.. in the mostrar they're just trying to make things más dramatic por making him repetively come back and seem creepy, but in the book he kills himself.
In the books, Toby is dead (he killed himself because of all the stuff with Jenna. He thought that Emily knew what he did to Jenna, even though she didn't)
